Terms of Service

Who operates this marketplace

Farm Market Canada is operated by the proprietor of DeRoche Ridge. In these terms, we, us and the operator mean the marketplace operator; you means the person using the service. These Terms of Service and the Community Guidelines apply to profiles, listings, photos, groups, bulletin posts, messages, ratings and other activity on the service.

Your agreement and account

Read these terms and the Community Guidelines before creating or updating a profile. By selecting the agreement checkbox and saving your profile, you agree to both documents. If you do not agree, do not create a profile or participate. You must be at least 19 years old and legally able to enter the transactions you arrange. You must provide accurate account information, use your own account, protect access to it and not impersonate another person or business. You are responsible for activity you authorize through your account. Do not share an account to avoid a restriction.

A place to connect buyers and sellers

We provide a place for members to find farm goods, services and rural community connections. Unless we expressly identify ourselves as the seller in a particular listing, transactions are between members. We do not act as an escrow service, guarantee payment or delivery, or verify every member, listing, animal, registration, ownership claim or item. Members must check suitability, condition, ownership, health information, permits and identity before agreeing to a transaction. Buyers and sellers are responsible for their agreements, payments, taxes, pickup, transport and compliance with applicable law.

Conduct and prohibited use

The Community Guidelines form part of these terms. Swearing, obscene or sexually explicit material, harassment, threats, bullying, malicious personal comments, discriminatory abuse, fraud, spam and unlawful activity are prohibited. These rules apply to public posts and private messages. Do not share someone else’s personal information without permission, manipulate ratings, submit knowingly false reports, post stolen goods, misrepresent animal health or registration, exploit the service or interfere with its security. Do not use a new account or another network to evade a restriction.

Your content and our permission to use it

You retain ownership of content you submit. You must own it or have permission to use it, including photos, logos and other people’s information. You grant us a non-exclusive, royalty-free permission to store, reproduce, display, format and distribute your content as reasonably needed to operate, secure and moderate the marketplace. This permission does not give us ownership of your work or an unrestricted right to sell it. Copies may remain where reasonably necessary for backups, safety records, disputes or legal obligations, subject to applicable privacy law.

Moderation and account termination

To protect members and the service, we may reject, restrict, close or remove content; issue a warning; limit features; suspend an account temporarily; or terminate access indefinitely for violations of these terms or the Community Guidelines. This includes repeated rudeness, insults, malicious comments, harassment, swearing, inappropriate material, scams and attempts to evade moderation. We may act on a single serious incident, a pattern of misconduct, credible safety concerns or legal requirements. A warning is not required before urgent or serious action. We exercise these powers reasonably, consistently and subject to applicable law. A termination may be implemented as an indefinite account suspension; it does not necessarily erase the account or records. Access restrictions do not cancel lawful obligations between buyers and sellers.

Reports and review

Use Report listing or the group report control to flag a concern and provide factual details. A report is not proof of wrongdoing, and moderation may require further investigation. Where practical and safe, we may explain a decision and consider additional information. You may request a review through an operator contact method if one has been provided; there is currently no dedicated in-site appeal form. Reinstatement is not guaranteed. Good-faith complaints, respectful disagreement and the exercise of legal rights are not violations simply because they criticize the marketplace. For an immediate threat or emergency, contact appropriate emergency services.

Sponsorship and fees

Sponsored content is identified separately from ordinary listings. An advertisement or external link is not a guarantee or endorsement of an advertiser. Any paid sponsorship or other paid service requires separate agreement on its price, duration and applicable cancellation or refund terms before purchase. These terms do not introduce an automatic subscription or give us permission to charge an undisclosed fee. Mandatory consumer rights continue to apply.

Privacy and safety

Profiles and listings expose the public details you choose to publish, such as your username, farm name, town, listing information and photos. Administrators can access information used for moderation, including relevant account details, reports and recorded network addresses. Avoid posting exact home addresses, financial information or other sensitive details publicly. These terms are not a substitute for a separate Privacy Notice and do not constitute blanket consent to unrelated uses of personal information.

Availability and responsibility

The service may be interrupted, changed or unavailable, and member information may contain errors. We do not guarantee continuous availability, successful sales or the conduct of another member. To the extent permitted by law, we are not responsible for losses arising solely from another member’s acts, inaccurate member content or a transaction to which we are not a party. Nothing in these terms excludes liability or removes a right that cannot lawfully be excluded, including applicable consumer protections. We remain responsible for obligations the law places on us.

Changes and applicable law

We will publish updated terms with a new version and effective date. Material changes will be presented for renewed agreement before continued member participation; changes do not retroactively remove accrued rights. These terms are governed by the laws of British Columbia and applicable Canadian federal law, subject to mandatory protections that apply where you live. They do not require compulsory arbitration or waive access to a court, tribunal or regulator. If one provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law.
